Federal Court Strikes Down Immigrant Visa Suspension Affecting Bangladesh and 74 Other Countries

Major setback for the Trump administration’s immigration policy as New York federal judge rules against broad visa suspension

A New York federal court has delivered a major legal setback to the Trump administration’s immigration policy, striking down the suspension of immigrant visa processing for citizens of Bangladesh and 74 other countries.

In a ruling issued Friday, U.S. District Judge Janet Vargas found that the broad suspension of immigrant visa processing based on nationality was unlawful. The ruling also concluded that Secretary of State Marco Rubio had exceeded his legal authority in implementing the policy.

The court emphasized that an applicant’s eligibility for an immigrant visa cannot be determined solely on the basis of nationality. Under U.S. immigration law, applicants are subject to individual assessments based on their circumstances, eligibility and other relevant factors.

Major Significance for the Bangladeshi Community

The ruling carries particular significance for the Bangladeshi-American community in New York and across the United States.

Bangladesh was among the 75 countries whose immigrant visa issuance was suspended beginning in January 2026. The policy created uncertainty for thousands of applicants seeking to permanently relocate to the United States.

For Bangladeshi families in Jackson Heights, Jamaica, Queens, Brooklyn, the Bronx and surrounding communities, the decision could have a direct impact on relatives who have been waiting in Bangladesh for immigrant visa processing.

Why Were the Visas Suspended?

The Trump administration argued that immigrants from the affected countries could be at greater risk of becoming dependent on government assistance after entering the United States.

Based on that concern, immigrant visa processing for nationals of 75 countries was suspended.

The federal court, however, determined that the government could not broadly apply the same restriction to applicants simply because of their nationality.

The court stressed that immigration applications must be evaluated individually rather than imposing a blanket restriction on citizens of an entire country.

New Hope for Family Reunification

The suspension had created significant uncertainty for U.S. citizens and lawful residents seeking to bring their spouses, children and other eligible family members to the United States.

Some families had already completed significant portions of the immigration process but were left waiting for visa issuance.

The court’s ruling could provide a new legal pathway for those cases to move forward, although the actual timing of resumed processing will depend on subsequent actions by U.S. immigration and consular authorities.

Bangladesh Among the 75 Affected Countries

The list of affected countries included Bangladesh as well as nations across Asia, Africa, the Middle East, Latin America and the Caribbean.

Other countries included Afghanistan, Iran, Pakistan, Russia and Somalia, among others.

The suspension primarily affected people seeking immigrant visas for permanent residence in the United States.

Important Clarification: Visitor Visas Were Not Covered

For the Bangladeshi community, it is important to distinguish between immigrant and nonimmigrant visas.

The suspension addressed immigrant visas—those intended for people seeking permanent residence in the United States.

It did not constitute a blanket suspension of visitor, tourist, business or other nonimmigrant visa categories.

What Happens Next?

The federal ruling creates an important legal opening for immigrant visa processing involving nationals of the affected countries.

However, questions remain over how quickly processing will resume and how pending applications will be handled.

The Trump administration could challenge the ruling in a higher court, potentially creating another round of legal proceedings. Until further guidance is issued, applicants will need to closely monitor official announcements from U.S. immigration and consular authorities.

Another Legal Challenge to Trump’s Immigration Agenda

The decision represents another significant judicial challenge to the Trump administration’s broader immigration agenda.

At the center of the ruling is the principle that immigration decisions should be based on individual eligibility and established legal procedures rather than nationality alone.

Bangladeshi Families Await the Next Step

For Bangladeshi families across New York and the United States, the ruling brings renewed hope after months of uncertainty.

Thousands of families with relatives waiting in Bangladesh are now watching closely for the next steps from the U.S. government—particularly when and how their pending immigrant visa applications will once again move through the system.
