H-1B Salary Threshold Could Reach $140,000 Under Proposed Bill

Proposed legislation could increase hiring costs for certain employers and reshape foreign-worker recruitment in the United States.

Sadia J. Choudhury:
— A proposed bill in the United States could significantly change salary requirements for certain employers hiring foreign professionals through the H-1B visa program, with a potential salary threshold of approximately $140,000, according to a report by Newsweek.

The proposal has drawn attention because of its potential implications for businesses that rely heavily on H-1B workers, particularly in the technology and other specialized industries. If enacted, the measure could increase labor costs for some employers and prompt companies to reconsider their foreign-worker recruitment strategies.

The proposal is aimed at addressing concerns over employers hiring foreign professionals at comparatively low wages and relying extensively on the H-1B program. However, the proposed threshold should not be interpreted as a universal minimum salary for every H-1B worker. Its actual scope would depend on the bill’s provisions, including which employers and positions would be covered.

The H-1B visa program allows U.S. employers to hire foreign professionals for specialty occupations requiring specialized knowledge and, generally, a bachelor’s degree or its equivalent in a related field. Workers from countries around the world, including Bangladesh and India, use the program to pursue professional opportunities in the United States.

If the proposed salary requirement becomes law, employers covered by the measure could face higher payroll expenses. Smaller companies and businesses that depend heavily on recruiting international talent may need to reassess their hiring budgets, compensation structures and staffing plans.

Supporters of stricter wage requirements argue that stronger salary protections could help prevent employers from underpaying foreign workers and protect U.S. workers from unfair wage competition. Critics, however, may contend that a substantial increase in salary requirements could make it more difficult for smaller employers to hire qualified international professionals.

The proposal could therefore have implications for both employers and prospective H-1B applicants, particularly those seeking entry-level or lower-paid positions. The extent of the impact would depend on the final language of the legislation and how any new requirements are implemented.

For now, the proposed $140,000 threshold is not a finalized, universally applicable H-1B salary requirement. Any changes would depend on the legislative process, including congressional consideration, possible amendments and final approval.

For foreign professionals planning to work in the United States, the proposal is another development worth monitoring as lawmakers continue debating immigration policy, worker protections and the role of international talent in the American economy.
