Federal Investigation Examines Minnesota Congresswoman’s Immigration Records; Phone Seized During Search of Washington Home
Sadia J. Choudhury:
— October 15, 2026 — The U.S. Department of Justice has issued approximately a dozen grand jury subpoenas, including to members of Rep. Ilhan Omar’s family, as federal investigators examine questions surrounding the Minnesota Democrat’s immigration history and citizenship records, according to people familiar with the investigation.
The subpoenas were issued on Friday, October 9, ahead of a court-authorized search of Omar’s Washington, D.C., residence on Monday, October 12. Federal agents also seized the congresswoman’s personal cellphone during the search, according to reports by NBC News, The Associated Press and CBS News.
The investigation, centered in Minnesota, is examining potential discrepancies in immigration paperwork, including questions about Omar’s birth date and the circumstances under which she obtained U.S. citizenship. The precise scope of the investigation and whether it will result in criminal charges remain unclear.
According to NBC News, Omar herself was not among those subpoenaed. Investigators are seeking information from family members and other sources as a federal grand jury gathers evidence.
Investigation Focuses on Immigration and Citizenship Records
Omar was born in Somalia and came to the United States with her family in the 1990s after fleeing the country’s civil war. She became a U.S. citizen in 2000 through her father’s naturalization.
Investigators are examining allegations concerning whether information about her age and family immigration history was accurately reported in official documents. Omar has repeatedly rejected allegations of immigration fraud, describing them as baseless.
No criminal conviction has been established in connection with the allegations, and the investigation remains ongoing.
The Department of Justice has not publicly provided a comprehensive account of the evidence being examined. Federal authorities have also not announced any criminal charges against Omar in connection with the immigration inquiry.
Omar Accuses Administration of Political Targeting
Omar, a frequent critic of President Donald Trump, has characterized the federal investigation as politically motivated.
Following the search of her home, she accused the administration of using federal law enforcement to target political opponents. She also said she would not be silenced by the investigation.
Democratic lawmakers and other critics have raised concerns about the timing of the search and subpoenas, which came just weeks before the November 2026 midterm elections. The Justice Department has historically followed practices intended to prevent investigative actions from improperly influencing elections.
The timing has intensified political debate over the independence of federal law enforcement and the treatment of elected officials under investigation.
Separate Scrutiny of Financial Disclosures
The investigation into Omar’s immigration records is unfolding alongside separate scrutiny of her financial disclosures.
Washington, D.C., U.S. Attorney Jeanine Pirro has acknowledged that her office is examining issues related to the congresswoman’s financial filings. Earlier disclosures listed a substantial increase in the reported value of assets associated with Omar and her husband, Tim Mynett. Omar subsequently amended the filings, attributing the discrepancy to an accounting error.
The two matters involve different questions, and the existence of an investigation does not establish wrongdoing.
Questions Remain as Federal Probe Continues
The investigation has drawn national attention because it involves a sitting member of Congress, long-standing allegations about immigration records and federal investigative activity shortly before a major election.
Authorities have yet to publicly establish whether the inquiry will lead to criminal charges or other legal proceedings. For now, investigators continue to gather records and testimony while Omar maintains that the allegations against her are politically driven.
The case is likely to remain under close scrutiny as further details emerge about the evidence, the scope of the investigation and the legal process governing any potential action against the congresswoman.
